Federal preemption watch
H.R. 8413, the SECURE Data Act (Securing and Establishing Consumer Uniform Rights and Enforcement over Data Act), introduced in the House on April 21, 2026 by Rep. John Joyce and referred to the Committees on Energy and Commerce and the Judiciary, proposes a national consumer privacy framework. As a bill, its preemption provision is only proposed: if enacted, it would preempt state laws relating to its provisions. It is not law, and no comprehensive federal privacy statute currently preempts state comprehensive privacy laws. That qualification is distinct from sectoral preemption, which does exist: COPPA, HIPAA, GLBA, and FCRA each preempt state law in part within their own subject areas.
