FTC personalized-pricing policy statement and study

Industry: All industries · Track: Compliance

FTC work on personalized and surveillance pricing: on August 19, 2026 the Commission voted 2-0 to publish a proposed enforcement policy statement (Docket FTC-2026-1057) on the use of consumers' personal data to set individualized prices. The proposal asserts that failing to disclose personalization, its basis, and the types of data used, where consumers reasonably expect prices not to vary by personal data, may constitute an unfair or deceptive act or practice under Section 5 of the FTC Act. The original comment deadline of September 18, 2026 was extended seven days to September 25, 2026; the comment period has closed. The earlier Section 6(b) surveillance-pricing study (January 2025) is separate research, not a rule.
