FTC Act Section 5: privacy and security enforcement
Section 5's prohibition on unfair or deceptive acts or practices is the FTC's general privacy and data-security enforcement vehicle, developed through complaints, consent orders, and litigated decisions rather than a single privacy rule. The Commission issued its final Decision and Order concerning General Motors LLC, General Motors Holdings LLC, and OnStar LLC's driving-data practices on January 13, 2026, and announced the finalized order by press release on January 14, 2026. The Texas AG's separate GM action is a distinct record.
